Sharia Court Allowed Rapist to Marry His 13-year-old Victim


Flickr-yunir-400x265Complications arising from overlapping state laws with religion are never-ending, particularly with Islam. Much of Borneo and the former British colonies on the island were Christian before what is now the state of Sabah and Sarawak (aka East Malaysia) entered a federation with Muslim Malaysia.

As Malaysia evolved so did internal migration and cross-culture absurdities inevitably came about. This reality was highlighted this week by a case involving a Muslim man who raped a 12-year-old girl and was able to obtain permission to marry her under Sharia law – avoiding prosecution in the process.

Thankfully, local prosecutors are pursuing a statutory rape charge against 40-year-old restaurant manager Riduan Masmud, who allegedly had sex with the girl in a parked car outside the Sabah state capital Kota Kinabalu in February. The girl is now 13 and his defense is that he married her.

State officials in Sabah want the marriage annulled. The girl is known to be from a very poor family and in one interview Riduan said the rape was a case of “suka sama suka” (“mutual consent”).

He was quoted in a report as saying that he would let her finish her studies and “maybe later take up a cosmetic course with my first wife,” who he added was a make-up artist.

The father of the girl apparently accepted the marriage saying, “What else could I do?” Her case only came to light following complaints from an aunt.

Riduan is currently free after posting bail of about U.S. $2,600.

Earlier this week a court told the prosecution it had until June 6 to decide whether or not to proceed with rape charges against Riduan after legal moves were made in April to have the case withdrawn following the marriage.

Welfare groups were outraged that Riduan was allowed to marry the girl, although the Sharia Court that allowed the nuptials has apparently said it could be annulled because Riduan did not tell the court that this was his second marriage when he applied for a certificate to marry the girl.

Gerakan Wanita’s deputy chief, Ng Siew Lai, said Riduan should not be allowed to walk free.

“I am really disgusted with the action of the rapist, whose name I cannot even bear to say out,” Ng said. “The girl is just a child who has a future, but due to the action of the rapist, it has gone up in smoke.”

She added that all children and in particular girls must be protected until they reach maturity.

“Simply marrying the victim will be seen as seeking the back-door attempt to escape punishment,” Ng continued. “We can never allow a rapist to go scot-free after raping a victim by marrying her. Gerakan Wanita firmly believes that prosecution should be mandatory in statutory rape cases and marriage can never be a solution.”

  1. Hi, let us talk a bit on the legendary Sir Ramji :

    First note that, the fable called Ramayana says that Mr Ram the hero had 2 brothers, namely Sir Lakshmanbhai, who went into the forests…where??.. with Mr Ram and Sitaben and the other brother was Sir Bharatji, whose mother was jealous of the hero Mr Ram and told her hubby, who was a polygamist with three elderly wives, to chase the damn son away into the forests, which he did and got his daughter-in-law in real time trouble. This hubby must have pissed in his trousers when he heard the terrible news of his daughter-in-law’s kidnapping and that he, the beloved father-in-law, was the actual cause!! Wow, what a tale!

    Sir Lakshmnbhai kept vigil, by not sleeping at all, day and night, over Mr Rambhai and his beautiful wife whom the devil called Ravana lusted and adored her beauty and then eventually captured her and we don’t want to speculate on what he may have been doing, with his long black ding dong with her for those 14 good years, when Sitaben was young, ripe and fleshy. The question remains,…. did he abduct her for nothing in return??? Guess!! She may have got some Hindu babies but it is difficult to tell since Ravana, the devil, never wrote any epic like the mythological Ramayan otherwise we would have had another bull about Ravanayan! Phew, thanks for that!!!

    Now, Sir Lakshman, who was in the jungle with a bow and a few arrows to hunt for vegetables!!! …had never slept for 14 years and to “recover” that lost sleep, instead his wife Urmila, who was 1000kms away, was induced to sleep by the same goddess who had approached Sir Lakshmanbhai and without food, without water, without changing clothes, without going to the loo,.. she kept sleeping and sleeping and sleeping, zzzzz…..for 14 long years!!!

    Ravana’s son could only be killed by a man who had not slept for 14 years??? So, Sir Lakshmansaib knew that one day Sitaben would be kidnapped by Ravana and he would have to fight the devil’s son called Meghnadh who could be defeated by only a man who had not slept for 14 years.
    Inspite of knowing in advance why did Sir Lakshman leave Sitaben unprotected?? What were the monkeys who are always aware of the haps in the jungles, like the Earl Hanuman(monkey-man) and his cronies doing then? Where were they?? Why didn’t they fight Ravana?? Why did they allow “somebody’s” wife to be just picked?? And also, since Sir Rambhai was the Avatar of Shiva or Vishnu, how come he didn’t “create” a thing nor was he aware of Ravana gripping his lovely wife next to his body, tightly, or did she shout…”heeeelp…hee..eelp”??…nor did Sir Ram know where Ravana lived for 14 years with his then lovely wife!!!..Did the older Sitaben get chikus from Sir Ram ever or her interns were ruptured by then and she couldn’t have anymore hindu cuties??….and more and more silly balls about Sir Ramji!!

    Common brothers, the rope of Allah is long and everyone can hold on to it…because there is peace and no nonsense as you claim it to be on this site!!

    Muslims are more honest and God fearing people.

    Concerned for those 14 years wasted of Sitaben and flying like a bird holding her breasts tight close to the body of the “Evil” fake Ravana!!!!! Instead of wasting your precious time, attacking other people’s faith, why don’t you concentrate on writing the Epic of Ravanyana??

    • The problem is that, a 13 year old victim is neither ready for marriage, nor can she decide what is right for her. Also, why should a lady marry a man, who raped her. Don’t she has her own free will and choice?

      • If a raped girl wants to marry you, will you marry? Phoolan Devi, famous personality of your India, was married in the age of 11 with 45 years old man in the exchange of a bicycle. Had she not free will? First look at your own state and then criticize others.

        16 “If a man seduces a virgin who is not betrothed and lies with her, he shall give the bride-price for her and make her his wife. 17 If her father utterly refuses to give her to him, he shall pay money equal to the bride-price for virgins”.

        What ya say to that??

        Islam is better as Quran does not sanction Rape nor Adultery and Fornication.

  2. Sharia court demanded for marriage and this is their fault but Hindus rape and kill the girls. This is right hahaha. In India, a new girl is raped in every 24 minutes according to wikipedia. To marry a rapists with that girl was a kind of punishment for rapists. Who will marry a raped girl? Can you marry? No? Then what would happen with raped girls if other person reject them. It is enough to order a rapists to marry that girl to save the future of girl.

      If the justice system is dubious to the hard headed Indians then to reduce the rapping incidences they should be forced to marry the poor and starving cows instead. At least cows can take their care by giving free milk as they are godly too!! The Western culture that the Indians so much get carried away with, has germinated the seed of gay marriages so why can’t marrying the rapist to a young cow be possible?too??

      The Manusmitri places stress on the suitability of the groom and makes it clear that marriage of a girl before her first menstruation was permissible. In the Baudhayana it is said that a girl should be given in marriage to a suitable groom even if she is immature, and that if she is mature she should be given in marriage even if the groom is unsuitable.

      Hindu religion enjoined parents not to keep a girl unmarried even at as small an age as 8 years. Puberty sets in among Indian females generally after 11 years, when any marriage is considered unholy.
      Jayalsaid that, “Hindu law gives clear injunction not to keep a girl unmarried beyond 12 years Keeping girls unmarried until their first menstruation would condemn the family to hell.

      As Paitinashi said, “A damsel should be given in marriage before her breasts swell. But if she has menstruated before marriage, both the giver and the taker fall into the abyss of hell; and her father, grandfather, and great grandfather are born insects in ordure.” Hindu scriptures sanctioned both child marriage and early consummation, “the girl should be married before puberty and certainly immediately after her first menstruation. If a girl gets married after her first menses it would not be a Kanya-dan but stree-dan”.

      Kanya-dan can be consummated at the most at 11 years of her age.” In one of the scenes in the Shastras a father addresses his father-in-law on giving her in marriage, “I have brought this girl up for eight years like a boy. I now give her away to your son, treat her with affection.” (Nagi 1993:4).
      The Manu, Mahabharata and the Vishnu Purana decreed that the man should be three times older than the girl, thus a man marrying a ten year old should be thirty, an eight year old girl should marry a man of twenty-four and so on”.

      “A person of one and twenty years(21) of age should wed a girl of seven(7) years of age”.

      “A person of thirty years of age should wed a girl of ten years of age called a Nagnika”.

      “…………wedding a girl after purchasing her at a high cost and after gratifying the cupidity of her kinsmen. Slaying and cutting off the heads of weeping kinsmen, the bridegroom sometimes forcibly takes away the girl he would wed…..”.

      Of the five castes only three are correct, Brahma, Kshatra, and Gandharva forms are righteous. It means two others should not marry, the Paisacha and the Asura forms should never be resorted to! Imagine Mahabharata discriminating!!

      “A Brahmana can take three wives. A Kshatriya can take two wives. As regards the Vaisya, he should take a wife from only his own order”, means of his own tribe.

      “Persons belonging to the three higher orders may take, only for purposes of enjoyment (and not for those of virtue), wives from the lowest or the Sudra order”, imagine that!!

      “That girl who has no brother nor father should not be wed”

      “But the engagement that is entered into by the wedder and wedded, with the aid of Mantras, is very much more so (for it is this engagement that really creates the relationship of husband and wife)”…funny, how do Mantras(Chants or Psalms) help in binding a marriage contract??

      “According to the dictates of the scriptures, the husband should regard his wife as an acquisition”, means as a chattel, a tool, like a piece of a furniture!!. Really?

      “Incurs no reproach by accepting for wife a girl that had been promised to another by her kinsmen”. More and more bulls…

      It is the Aryan culture, however, that has dominated and has had the most influence on the society. Child marriage is an institution sanctioned by ancient Hindu laws and devotedly practiced by its followers. In the ancient Hindu scriptures of 400 to 100 BC, there are strict moral laws that enjoin the father to marry off his daughter at a very young age. These religious texts indicate that the best age for a girl to get married is between is 8 and 10. It has been also mentioned that a girl should not wait for marriage
      more than three years after attaining puberty, and if she is not given by then in marriage by her father, the texts even instruct her to get married on her own. Such religious texts ( the Bishnu Sutra and Gautam Sutra) direct the father to marry his daughter within three weeks of attaining puberty, and no later.

      The religious texts of that time contain strict moral laws that enjoined the father to marry off his daughter before she reaches puberty. Sage Manu of that age has categorically written in his treatise, Manu Smriti, that if a girl remains unmarried after reaching the puberty, the father has failed in his duty towards her. Similarly, another sage, Parasara, said that the parents or guardians of a girl in who reaches puberty before marriage will definitely go to hell. Such rules imposed by the “holy ones” had their effect upon the religious population, and the practice of child marriage was firmly established by 200 BC. Even the marriage of infants became common. The ceremony of marrying off a daughter is still called “Kanyadan”, which literally translates as “the gift of a virgin”. According to the Hindu belief, the act of Kanyadan earns a lot of “punya” or spiritual credit to the father.

      According to the first report prepared under the Demographic Sample Survey, 1986/87, it is stated that nearly 7% of girl children were found to be married before reaching the age of 10.

      According to the population census of 1991, the total number of males and females in the age group 10-14 are 118,541 and 109,054 respectively. Among the males, 108,091 are single, 3,992 married, 117 are widowers, 82 are divorced and 33 separated. The rest (6,225) males had not stated their marital status.

      Child marriage is a gross violation of child’s rights ; it robs children of their childhood, hinders their growing up process and forces them into the dark abyss of an uncertain future. Since most of the victims of this practice are girl children, it is they who suffer most from the devastating effects of this evil practice.

      Without the Muslim and British rule that curbed the size of their mythological beliefs the supersticious dudes who flaunt their religious scriptures in every sense would have continued with Sati practises and child marriages phenomenally to date!!
